Minutes of the regular monthly meeting of the Town Board of the Town of Olive held Monday, November 13, 2000, 7:30 pm at the Town Meeting Hall in Shokan, NY.

On a La Monda/Chase motion the Town Board approved accepting the Minutes of the previous meetings as submitted.
Supervisor Leifeld introduced David Lenefsky attorney representing Masterpage in the South Mountain wireless application. Mr. Lenefsky stated he would like to establish an informational meeting with the Town Board and his clients prior to the balloon testing since they would like to have input from the Town Board. Council Member La Monda stated he would like to hear from our Consultant. Mr. Lenefsky stated that Mr. Comi has reviewed the application and it has been revised and resubmitted. Council Member La Monda stated his concern is the need to obtain information regarding the application plan from the Town's consultant Richard Comi. Mr. Lenefsky stated the meeting would be for the purpose of the Town Board answering initial questions and to establish a procedure for balloon testing. Council Member Chase suggested the Town Board have a meeting with Mr. Comi prior to meeting with Mr. Lenefsky. It was determined that the Town Board will meet with Mr. Lenefsky and his clients on December 4th, 8 pm. It was noted the monthly audit meeting would be moved up to 7 pm to accommodate the 8 pm meeting.
Supervisor Leifeld stated he would contact Mr. Comi to schedule a meeting prior to meeting with Lenefsky. However, he noted that if our consultant comes the same night as the applicant then the applicant pays the consultant, otherwise the Town pays for his attendance.

SHARP Committee Director Jane Todd noted a new grant has been received for rehabilitation of residences and businesses.

The Association of Towns announces the annual meeting will be February 18th in New York City. Supervisor Leifeld noted that if any Town representatives are interested in attending the application forms should be submitted at the January meeting.

Attorney Drayton Grant representing Olive CARES stated they would like the opportunity to meet with the proper local officials and Town consultants to discuss the best possibilities for constructive amendments to the Town's wireless law, Local Law #3 of 2000.
Linda Barash stated Olive CARES and their attorney would like to have a meeting to go through the law and review suggestions for changes. She stated they would like to have a general discussion with the Town Board prior to approval of any wireless structures. Council Member La Monda stated an amendment on the law could possibly be a lengthy process further stating it might not be cost effective for the Town to pay a consultant and Olive CARES to pay an attorney. Mr. Barash stated that Olive CARES has been sponsoring meetings for months and they are working through committees on various subjects. He stated their organization would like to suggest things to the consultant and to the Town Board in an effort to use the information in the best way possible. He stated that Attorney Drayton Grant would like to meet to ask specifics noting they would like to do it with the Town Board instead of being demanding.
Supervisor Leifeld stated he would like to meet with Olive CARES and their attorney first prior to sitting down with our consultant. The Town Board was in agreement.
Council Member La Monda stated the Town has a law in place at this point and anyone applying under that law would be subject to the current law. He stated that he understands the South Mountain application is requesting a set back variance and noted his opposition to setting a precedent by granting a variance. Council Member Chase requested copies of all correspondence involved in the South Mountain application, including the revised application. Supervisor Leifeld stated that if New York State, being an adjoining property owner, is in opposition to the variance being granted then the process could be a long drawn out affair.
Linda Barash stated she was hoping to have a meeting with Mr. Comi to know what his comments are on the application process. Noel Barash stated since Mr. Comi developed the law, wouldn't it make more sense to have Mr. Comi there to respond to questions to which he might only have the answers.
The general consensus was that either November 20 or 21st would be a good date for a meeting with Olive CARES. Linda Barash stated she would contact Supervisor Leifeld on Tuesday, November 14th, to confirm the date.
On a La Monda/Johnansen motion the Town Board approved payment of the following preaudited bills: Prepaid vouchers #500-#501, $687.51; Prepaid vouchers #10 Special Lighting, $39.13; General Fund Vouchers #502-#548, $18,628.46; Highway Fund Vouchers #263-#309, $30,412.67; and Reserve "D" #2, $354.72.
Supervisor Leifeld asked for potential dates for meeting with the Olive Fire Department regarding the upcoming contract. General consensus was the 20th or 21st.
Supervisor Leifeld stated the Town Justices are having a problem with junk yard violations being unenforceable and would like to set a meeting with the Town Attorney to revise the local law. The general consensus of the Town Board is to start this procedure in January.
Supervisor Leifeld noted the monthly income as cash received for September, $54,605.65 and interest through September as $52,670.44.
The following committee reports were filed:
PARKS AND RECREATION: Supervisor Leifeld stated he has the blueprint for the proposed pool plan from Clayton Besch stating that he and Council Member Burkhardt would be co-workers on the pool plans.
TRANSFER STATION liaison Council Member La Monda stated that thirty (30) permits were sold in September and $5,785.00 total revenues were received. Supervisor Leifeld stated that Brandon Krum is back in the hospital and the Town should hire a part time person. He noted this position would be temporary part-time, less than 20 hours a week for $10.00 per hour, and no benefits would be provided. Supervisor Leifeld noted that funds are in the budget to cover this. General consensus of the Town Board is to have Supervisor Leifeld hire someone for this temporary position.
Anne Altshuler stated at her last Transfer Station visit she noticed that c & d is being accepted. Council Member La Monda stated we do not accept commercial c & d, only small trucks or household, reiterating the Transfer Station is not to accept from contractors. Anne Altshuler asked how does anyone know what is in c & d, noting items such as asbestos shingles. Council Member La Monda stated that Bruce Proper does keep a good eye on what is coming in and where things are dumped. Supervisor Leifeld stated that another "checks and balances" is at the county level where someone monitors things coming into the UCRRA.
HIGHWAY liaison Chase submitted the year end report for 2000 (#65-2000) noting 4.5 miles of reconstruction and oil and chip, 1.7 miles of reshale and item #4, 15.4 miles of ditching, and 29 culvert pipes replaced.
CONSERVATION ADVISORY COUNCIL representative Altshuler noted that an electronics drop-off date is being set for November 18th, 9 a.m. - 2 p.m. on Sawkill Road. She noted that nominal charges would apply to those wishing to discard old electronic equipment.
Town Clerk Rozzelle thanked the Town of Olive Police and Voting Custodians Angelo Russo, Joe Vanacore, William Lohrer, and Ralph Vanacore for assisting in seeing that the Election process ran smoothly. She also noted that Olive Town Board Minutes are posted monthly on the Town website:

Supervisor Leifeld presented the 2001 Budget for approval noting the Public Hearing was held on November 9th. He noted that General Fund appropriations increased 2.75% and amount to be raised by taxes is approximately a 1.14% decrease due to a projected unexpended balance of $200,000.00. He noted a 3.47% increase in the Highway Fund appropriation with a decrease in amount to be raised by tax of 5.1% due to an unexpended balance of $127,000.00. On a La Monda/Chase motion and unanimous roll vote the Town Board approved the Town of Olive Budget for the year 2001. Roll vote being: Johansen, yes; Chase, yes; La Monda, yes; Burkhardt, yes; and Leifeld, yes.
Council Member La Monda made a motion to dedicate a page in Minute Book in memory of Town of Olive Assessor Clerk Susanne Toleno Hyde and long time Olive resident Antoinette Tennant. This motion was seconded by Council Member Burkhardt and passed unanimously.
All business pertinent having been discussed the Town Board adjourned at 8:30 pm on a La Monda/Burkhardt motion.
