December 7, 2004

Minutes of the monthly audit and regular monthly meeting of the Town Board of the Town of Olive held at 7:30 pm at the Town Meeting Hall, Bostock Road, Shokan, NY. The Town Board audit meeting of December 6th was cancelled due to inclement weather and was rescheduled to be combined with tonight’s meeting.

On a Burkhardt/Chase motion the Town Board unanimously approved the October minutes of the Town Board.

The following correspondence was read and filed:

Senator John Bonacic responded to the town’s request to revise the Large Parcel law by stating he will do his best to notify the town of any proposed changes to this legislation "keeping in mind that I represent nearly 80 municipalities and approximately 20,000 bills pass my desk each legislative year making it difficult to review each of them in great detail." Deputy Supervisor La Monda stated the Town Board requested in the letter that he implement a change in the law but he did not address that issue. Deputy Supervisor La Monda stated that Assemblyman Cahill has not responded to the Town Board’s letter.

Time Warner, Inc., stated rates would be adjusted in 2005.

Timothy Cox, Corporate Counsel for the Catskill Watershed Corporation, submitted copies of a contract for the town’s participation in the Community Wastewater Management Program in Boiceville. Deputy Supervisor La Monda moved that the Town Board table empowering the Supervisor to sign said contract allowing time for the board to review it. Council Member Burkhardt seconded this motion.

Central Hudson Gas & Electric Corporation outlined the processes involved in installing holiday decorations attached to Central Hudson poles.

Cole Layer Trumble President Bruce F. Nagel thanked the Town Board for awarding their company the contract for revaluation of properties in Olive.

Deputy Supervisor La Monda stated Art Scheuermann, Director of Legal Services for the School Adminstrators Association of New York State, faxed a memorandum to the Town Board stating that legally the Town of Olive cannot secede from the Onteora Distriction due to the town not meeting the minimum population requirements of at least ten thousand inhabitants.

On a Burkhardt/Rank motion the Town Board approved the following audited claims: Highway Vouchers #348-#370, $101,167.28; General Fund Vouchers #668-#705, $70,852.06; and Special Fire District Voucher #3, $160,200.00.

On a La Monda/Chase motion the Town Board unanimously approved the reappointment of Bert Ketchum as member of the Board of Assessment Review. His term will expire 9/30/09.

Deputy Supervisor La Monda noted the monthly income for October as $73,247.88 and the interest received through October as $13,594.54.

The following committee reports were submitted:

FIRST AID liaison Council Member Chase submitted report #129-04 noting 337 miles traveled, 60 volunteer hours expended with 7 ALS and 4 BLS reported for the month of November.

TRANSFER STATION liaison Council Member Burkhardt submitted October report #130-04 showing $6,420.00 in revenues and 79.81 tons removed at a cost of $5,586.70.

POLICE Commissioner La Monda submitted November report #131-04 noting 50 total calls were handled for the month.

HIGHWAY liaison Council Member Rank submitted report #132-04 for the months of October and November outlining highway department work completed in addition to winterizing and mulching leaves in the parks, installing new soccer nets in Olivebridge Park, and installing the new lift in the garage.

TOWN CLERK Rozzelle noted the Ulster County Department of Health states that phone in appointments for flu shots will be one day only on December 15th. She noted that Bill Tobin of the Ulster County Traffic Council has expressed interest in having a representative from the Town of Olive attend their meetings. She commended Wendy Wolfenson of West Shokan for writing an essay that resulted in $10,000.00 in electronic equipment being donated to Bennett School. She introduced correspondence #133-04 from Alison Stankrauff, Archives and Assistant Librarian at the Franklin D. Schurz Library at Indiana University South Bend, enclosing a publication of the Ulster County Gazette published by the New York Public Library in 1931 as well as an edition of the Ulster County Gazette which they are donating to the Town of Olive Archives. The Town Clerk November report (#134-04) notes $8,016.93 in monthly revenues.

On a La Monda/Chase motion the Town Board unanimously approved Peter Kothe and Charles O’Keefe as members to the Olive Fire Department. (#135-04)

Deputy Supervisor La Monda stated the first meeting of the Citizens of Olive Large Parcel Review Committee was quite interesting and active He noted that Supervisor Leifeld has appointed the following persons to the committee helping us in the large parcel issue: Kathleen Ruiz, Claire Kassor, Rita Vanacore, Amy Firedman, David Norton, Henrietta Wise, John Tisch, Jack Conaway. He stated he will be attending these meetings just to assist if the committee should require information regarding the bill. Council Member Rank stated the committee is meeting tonight due to the inclement weather last night further noting they will be organizing themselves tonight.

Deputy Supervisor La Monda stated that the group now known as the Olive 13 went to see Assemblyman Cahill and they contacted him and other members of the Town Board to express their disdain about the treatment they received from Assemblyman Cahill. He stated that he knows these people are not loose cannons and he shares their concern about the lack of results and the treatment they received from Assemblyman Cahill. He noted that to date the town has not received a response from Assemblyman Cahill regarding the petitions and letters sent to his office
